
The Ministry of Spatial Planning, Urbanism and State Property has adopted a new
Rulebook on the Conditions for Performing and the Manner of Performing Design Supervision of Construction Works,
published in the “Official Gazette of Montenegro”, No. 047/25 of May 16, 2025.
This rulebook defines the conditions under which design supervision may be carried out, as well as the specific manner in which it is implemented during the construction of buildings. Supervision is carried out based on a contract between the investor and the responsible designer, i.e., the designer who prepared the main project. It may also be conducted at the request of the contractor, but only with the consent of the investor.
Design supervision includes the verification of technical solutions, approval of changes in the project documentation, alignment of materials and colors with applicable regulations, and regular site visits. It lasts throughout the entire construction period, up to the handover of the building for use.
If the contractor or investor does not act in accordance with the project, the designer is obligated to promptly inform the relevant authorities – including the construction inspection – and propose necessary measures.
Upon completion of the works, the designer prepares a final report, which must include a statement confirming that the building has been constructed in accordance with the revised project. If this statement is missing, the report is automatically submitted to the inspection authority and the commission for the technical inspection of the building.
The rulebook enters into force on the eighth day from its publication, i.e., on May 24, 2025.
This new regulation represents an important step toward improving construction quality control and increasing the accountability of all participants in the process. Design supervision is now given a formal framework, contributing to greater safety and compliance with regulations.
