The Ministry of Spatial Planning, Urbanism and State Property adopted the Rulebook on Amendments to the Rulebook on the Detailed Method and Procedure for Issuing and Suspending Licences for Performing Activities in the Field of Construction and the Method of Keeping the Register of Licences, which was published in the “Official Gazette of Montenegro”, No. 117/25 of 15 October 2025.

These amendments further specify certain provisions relating to the licensing of companies and entrepreneurs in the field of construction, with the aim of improving legal certainty and ensuring clearer application of regulations in practice.

Subject of the Amendments to the Rulebook

The amendments to the Rulebook relate to the improvement of terminology, clarification of the conditions for issuing and suspending licences, as well as certain technical corrections in the procedure for keeping the register of licences. Particular emphasis has been placed on harmonisation with the applicable Law on Construction and clearer definition of the entities to which the Rulebook applies.

The Rulebook, inter alia, further clarifies that its provisions apply to companies and entrepreneurs performing activities in the field of construction, thereby avoiding ambiguities in the interpretation of terms in proceedings before the competent authorities.

Key Novelties

The amendments to the Rulebook introduce the following key novelties:

  • more precise definition of terms relating to licensed persons in the field of design and construction, using the terms “licensed architect” and “licensed engineer”;
  • simplification and shortening of certain conditions that were previously prescribed for the issuance of licences;
  • amendment of certain deadlines related to the validity and suspension of licences, with the aim of greater flexibility for business entities;
  • technical harmonisation of provisions relating to the content and maintenance of the register of licences.

These amendments aim to make administrative procedures more efficient and requirements clearer and easier to apply in practice.

For companies and entrepreneurs performing activities in the field of construction, these amendments represent an important step towards a clearer regulatory framework. Entry into Force

This Rulebook on Amendments to the Rulebook on the Detailed Method and Procedure for Issuing and Suspending Licences for Performing Activities in the Field of Construction and the Method of Keeping the Register of Licences enters into force on the day of its publication in the “Official Gazette of Montenegro”. From that day, the amended provisions apply in procedures for issuing and suspending licences, as well as in maintaining the register of licences in the field of construction.
