New Rulebook on Recording the Working Hours of Mobile Workers in Road Transport

The Ministry of Transport has adopted the Rulebook on the Content, Method of Keeping and Form of Records on the Working Hours of Persons Performing Mobile Activities in Road Transport (“Official Gazette of Montenegro”, No. 028/26 of 4 March 2026), pursuant to Article 19, paragraph 5 of the Act on Working Hours and Breaks During Working Hours of Mobile Workers and Recording Devices in Road Transport.

The new Rulebook introduces uniform rules for keeping records of the working hours of mobile workers, with a clearly defined form and method of recording data, thereby improving compliance with the regulations and facilitating the monitoring of compliance with working time requirements.

What does the new Rulebook regulate?

The Rulebook prescribes:

• the content of records on the working hours of persons performing mobile activities in road transport;
• the method of keeping such records;
• the form on which the records are kept.

The records constitute mandatory documentation for employers who employ mobile workers in road transport and are intended to enable accurate monitoring of working hours in accordance with the applicable regulations.

Method of keeping records

One of the important novelties is that the records may be kept in the manner that best suits the organisation of the business.

The Rulebook prescribes that:

• the records may be kept in written or electronic form;
• they shall be kept separately for each person performing a mobile activity;
• they shall be kept on Form 1, which forms an integral part of the Rulebook.

In this way, greater flexibility in keeping records is ensured, while maintaining a uniform content of the data that employers are required to record.

Repeal of the previous Rulebook

Upon the entry into force of the new Rulebook, the Rulebook on the Form and Method of Keeping Records on the Working Hours of Persons Performing Mobile Activities in Road Transport (“Official Gazette of Montenegro”, No. 17/12) shall cease to have effect.

Accordingly, the previous form and method of keeping records are replaced by a new solution harmonised with the current legislative framework.

When does the Rulebook apply?

The Rulebook shall enter into force on the eighth day following its publication in the “Official Gazette of Montenegro”, and therefore employers engaged in road transport activities should timely harmonise their method of keeping records with the new requirements.

The new Rulebook introduces a standardised method of keeping records of the working hours of mobile workers and allows such records to be maintained in paper or electronic form. Employers in the road transport sector should review their existing procedures and, where necessary, harmonise their records and internal acts with the new regulations in order to comply with their legal obligations.
